VG published Wednesday evening an audio recording in which a defense lawyer in Oslo apparently asks one of his clients to kidnap and dope down a rape victim to get a rape accused client acquitted.
the aim of the alleged kidnapping plan was that rape victim should not appear in court to explain himself.
Although the lawyer said that the call is taken out of context, without prehistory is known and that the recording content has never been real.
First District Attorney Jørn Maurud asks police investigate defense attorney.
Now the police must investigate this. I will ask the police to investigate this with coarse obstruction of the judiciary, as it seems to be, says chief public prosecutor Jørn Maurud at Oslo public prosecutor told VG.
What appears, is serious, and the case should be investigated, said police inspector Grete Lien Metlid, head of the section of violence and sexual offenses in the Oslo police.
the female rape victim was never kidnapped, and the rape accused Romanian man lawyer was defending for, was sentenced to five years in prison, writes VG.
the recording is done by a violent and drug convicted man who was also one of lawyer’s clients.
Refuse planning
– I thought that you, with your background, maybe had some possible solutions. How is it if one is to kidnap with a person for a few days? ask the lawyer of the recording, which will be from May 20 last year, a week before the lawyer to defend one of two Romanian men in August 2013 beaten up and raped a junkie woman in their 40s.
Attorney denies that he was involved in planning a kidnapping. He told VG that the pressure from the man who made the recording, was so great that he mostly just “Gabby” the conversation the two had.
– I’ve said this. It sounds harsh, it’s unfortunate. But it never happened something, he said.
– I have several recordings of NN where he says that he will harm me and my children. Because of the threats, my family has stayed at a secret address over time, and we have been equipped with a security alarm, the lawyer said.
– Terrible
– If this is correct, then it absolutely awful. It goes in the case against all the basic principles of a legal act, and as depicted in VG, so this may be a criminal offense, said Secretary General Merete Smith Bar Association said. She referred to the Criminal Code Section 157 of obstruction of justice system.
Smith reports that the Bar Association will contact Advokatbevilling Tribunal on the matter. It is the latter that determines whether a practicing certificate shall be revoked or suspended.
If a lawyer may have committed a criminal offense, the case must be investigated by the police, but Advokatbevilling Tribunal may decide on revocation of license or suspension regardless of this .
