Krekar case: – Police have committed a serious procedural error – Aftenposten

It says Mads Andenæs, Professor of Law and an expert on human rights, told Aftenposten.

Tuesday morning, Oslo Court treat a 20 pages long complaint lawyer Brynjar Meling submitted on behalf of Mullah Krekar.

– Severe procedural error

Justice Minister Anders Anundsen instructed police to consider compulsory settlement and notification requirement for persons Krekar, where there is expulsion order that can not be realized.

Police have subsequently made a decision which probably is subject Administration.

– If they have not left Krekar get opportunity to express themselves, the police made a serious procedural error, says Andenæs.

In the complaint from lawyer Brynjar Meling, says lawyer according VG that state for months and years have been aware of when Mullah Krekar should be released after completion of the sentence.

“Missing notification appears as a result of either pure sloppiness or maybe just as well by an administrative authority – which prosecutors are in this case – under clear, albeit informally pressure from a political leadership with a strong and acute interest politically justified marking needs, “writes Meling.

– All that stands in the petition to the court is well thought out, says Meling said.

Exposed decision

Oslo police sent out one Friday pressemdlding where it became known that poltiiet would expose tvansgflyttingen to Kyrksæterøra to the complaint being treated in Oslo District Court.

Justice Minister Anders Anundsen not see it as a defeat that Mullah Krekar is a free man.

– I am proud that we live in a constitutional state. Getting a matter to court is a right that everyone in Norway has, and it is the privilege used now, says Justice Minister NTB that Oslo District Court shall decide whether the police decision on notification and moving to Kyrksæterøra hold water.
