OSLO (TV 2) : Justice Minister Anders Anundsen (FRP) has constantly argued that the instructions that led to the police decision to forcibly settle Mullah Krekar, is a general instructions, which were not designed to address the government Krekar problem.
But internal documents from the Ministry of Justice show that Anundsen still opened to instruct police in an individual case that Krekar case.
Opened to “instruct the police in an individual case”
It is therefore police made the decision to send Mullah Krekar to Kyrksæterøra, based on the general instructions from the Ministry of Justice. Anders Anundsen has repeatedly repeated that the instructions were not made specifically for Krekar.
But in an internal document from the 29th August last year, it emerges that Anundsen themselves considered to override the police and instruct them in an individual case.
In the document, which is sent from the police department in the Ministry of Justice to the political leadership, it says:
- “ Political management has raised the question whether it is possible to instruct the police in individual cases to require notification and / or specific whereabouts of Immigration is regarded as a threat to fundamental national interests, but provisionally protected against return. “
Secondly asked political leadership if it is also possible to provide “a general instruction that anyone deemed a threat to fundamental national interests”.
The document was initially exempt from public disclosure because of its internal nature, but but through an access requests it has successfully TV 2 to access multiple documents from work with the much talked instruction.

In the response from the police department gets justice minister and other members of the ministry’s political leadership and clear answer that they do not have the opportunity to instruct police in individual cases.
The lawyers in the Justice Department wrote this to his own minister:
“It is not entitled to instruct on coercive measures in individual cases where a decision is taken on the basis of fundamental national interests / foreign policy considerations. “
Kolberg: – This shows ANUNDSEN true intentions
The head of Standing Committee on Scrutiny and Constitutional Affairs, Martin Kolberg (Ap), says documents show what was Anders ANUNDSEN goal with the instruction.
– He has asked an instruction for individuals, and this shows what was his real intentions, says Martin Kolberg TV 2.
Kolberg reacted strongly to the Minister of Justice actually asked their lawyers about the ability to instruct police in individual cases.
– There is nothing to ask, we politicians know that we can not do such things, says Kolberg.
Would micromanaging whereabouts
There are in fact several documents showing how the political leadership of the Ministry of Justice wanted to micromanage forced residency.
Former State Secretary in the Ministry, Himanshu Gulati, writes in a commentary on 1 September last year that he would like to know as much as possible about how the ministry itself may stipulate compulsory residence in individual cases.
- “ Is it possible to provide any further guidance on how these persons shall be required to stay? I realize that it may be problematic to justify, but is there anything in the way of example being can instruct that in such cases shall be imposed a specific place to be outside the big cities? (Slightly more detailed specified in the instructions obviously) “

Justice Minister unavailable for comment
Justice Minister Anders Anundsen located tonight at EU Justice meeting in Riga and has not been available for comment.
Former State Secretary in the Ministry of Justice, Himanshu Gulati (now undersecretary of the Prime Minister’s Office), writes in an SMS that he and all questions about the documents should be directed to the Ministry of Justice.
– Since I am no longer in the Ministry of Justice, and this is an internal document from the Ministry must question whether this should be addressed to the Ministry of Justice, writes Gulati in an SMS to TV 2.
