Prosecutors advocates acquittal of Oslo Municipality in a lawsuit about two elderly women who died in 2010.

“After seven days evidence in court, it has emerged information that the police were not made known during the investigation, and that was basis that the municipality was fined for violations of the Health, “writes Oslo police said in a statement.

The case is about two deaths in Gamle Oslo spring 2010. In March, an 83 year old woman found dead outside the building where she lived at Kampen in Oslo. The demented woman had frozen to death.

The other woman (92) was found dead in his apartment in Greenland in Oslo in April. She had been dead for about two weeks when she was found.

State Health believed municipalities did not provide necessary and proper health care to the two women in the days before they died. In 92-year-old case had failure lasted for several years, according to Health.

The municipality was therefore fined 500,000 crowns, but refused to adopt this. In the writ stated inter alia that the municipality repeatedly from 2005 had been contacted by “relatives, neighbors and employees who pointed out that her mental and physical condition steadily deteriorated.”

A conviction could ended with a fine of 100,000 pounds more than the original writ, in addition to legal costs.

Inadequate proving

Police built their case on information the municipality has given to State Health. Although case contains information about “reprehensible and indefensible conditions”, says police attorney Paal-Fredrik Hjort Kraby it can no longer be proved that the municipality has acted negligently. It is the minimum requirement to be able to impose penalties for Health Personnel.

– The evidence prosecutors have had at his disposal, has unfortunately been inconclusive, something of evidence in court showed when the municipality presented their evidence, says Kraby.

The police will investigate why they did not receive all relevant documents in the case.
