Tajik: Very serious for Anundsen – NRK

Friday came the decision of the Court of Appeal, which abolishes the police decision to forcibly settle Mullah Krekar on Kyrksæterøra in Sor-Trondelag. The court criticized the Justice Department’s involvement in the case.

The Court believes unlike court that the instructions that Ministry of Justice gave the Oslo police in advance of their decisions may have influenced the content of the order of forced settlement.

– This is a very serious judgment. If left, it shows that Anundsen has exceeded its powers as Attorney General, says Tajik.

KrF: For poor work

She believes this is one of many cases where Anundsen want to show vigor.

– It has always been possible for the police to consider whether individuals who pose a danger to national security should rather stay somewhere else. Instructions to Anundsen, which the appellate court thinks is not valid, ordered police to always make this assessment. I observed that the Court of Appeal believes it does not hold, says Tajik.

– The verdict is surprising to me. I thought the government had done a thorough job. It is very special situation. A misjudgment from government side, says the Christian Democratic leader Knut Arild Hareide.

SQUEEZED: Justice Minister Anders Anundsen must answer how the ministry could make an instruction that the appellate court thinks is invalid.

Anundsen: Disagree

Justice Minister Anders Anundsen says he disagrees with the Court of Appeal.

– It is very regrettable that they have ended up with this. We believe there is a need for us to have better control of people who we believe pose a threat to national security, says Anundsen.

He said the ministry now must go through the Court of Appeal judgment.

– It may have the consequence that the instructions be withdrawn or that it changes, says Anundsen.

– Important for citizens

The attorney for Mullah Krekar, or Najmuddin Faraj Ahmad as his real name, Brynjar Meling told NRK that it is a good ruling.

– We are very pleased that the Court of Appeal gives us upheld. It’s a good ruling. And it is interesting that the appellate court uses the most fundamental argument, namely instruction opportunity. This is important for citizens who do not want a ministerial control in this country, says Meling NRK.

Police say they are considering an appeal to the Supreme Court.

In today’s ruling states also that the court repeal of move order is not something preclude police taking a new, independent assessment of whether to grant an injunction under the Immigration Act.
