Oslo police are considering an appeal Krekar ruling – Dagbladet.no

Oslo police believe the instruction to forcibly move Mullah Krekar is legal. They will now consider whether Borgarting Court of Appeal ruling to revoke the decision, shall be appealed to the Supreme Court.

– We disagree with tier court in that this is an illegal instruction, writes Oslo police said in a statement Friday.

The High Court concluded that Krekar can not be moved to a reception center on Kyrksæterøra in Sor-Trondelag. The court quashed Friday afternoon police decisions concerning compulsory settlement.

In its ruling comes right with strong criticism of the Ministry of Justice for wrongful having given the police instructions on forced relocation of Krekar.



– General Instruction

Police Inspector Vegard Rødås Oslo Police say the instruction was not intended to apply only to Krekar.

– We believe, first, that the instruction is general and that this sense is legal, it applies more people and is not aimed at one individual case, he says to VG.

Roda denies that Oslo police were influenced by the Ministry of Justice instructions, so the Court of Appeal concludes.

– This is a Police professional assessment that we matter had reached, he says the newspaper.

For NRK he says that the police over the weekend will consider whether the Court of Appeal ruling will be appealed to the Supreme Court.

Small significance

Krekar is detained in Kongsvinger prison while he investigated for having spawned new threats. Roda told Aftenposten that the police aim to keep him jailed until the main hearing in the case comes up for Oslo District Court before the summer.

Police ordered that Krekar should move to Kyrksæterøra is only valid until 31 December. If he is convicted of the new threats, the sentence hardly finished serving during the year. The appellate court’s decision thus has little practical significance.

– We still believe that Krekar represents a danger to national security and should be moved out of Oslo. Police decision has been made on a solid basis. The Court has not considered this basis, writes police press release.
