Withdraw the case against the man who cut the neighbor’s outbuildings into two – Dagbladet.no

The case against the man, who is charged with aggravated criminal damage, should started in court Monday. It did not because the prosecution has withdrawn the case, writes VG. The man’s lawyer, Trygve Staff, think the case will never come before the court, while police attorney Knut Christian Braae-Johannessen says the reason is that the civil law issues in the case are not yet settled.

– This case is about vandalism, but there is a civil matter in bottom. Anticipating that it be treated in Borgarting in May, so it has been decided to withdraw the case until the present, says Braae-Johannessen.

Last year, the district court ruled that the neighbors do not have property rights, but only use rights, the area where the outhouse stood. This is appealed by the 41-year-old and the police therefore want to wait with the criminal case to this dispute is settled.

– The matter will be considered on the basis of profit in Borgarting says Braae-Johannesen.

Lawyer Staff told the newspaper that he sees this as the case waived completely.

41-year-old does not deny that it was he who tore the outhouse, but believes that the house partially standing on his plot, and that he thus had the right to tear it standing on his property.
