Dropper domestic violence charges against Ndure – requesting prison for six months – NRK

The trial of Norway’s fastest man, JAYSUMA SAIDY NDURE, nearing the end. Ndure has been charged with several cases of violence against his former cohabitant (23) by the so-called “violence clause”.

Earlier Friday warned however Judge Jenanette Westlund Hegna that it might be appropriate to consider Ndure by Penal Code § 228 , concerning assault and have a much lower sentence.

This prosecution has taken into account.

Police Attorney Camilla Ek Sørensen said in his closing procedure that she believes there is insufficient evidence that ekssamboeren has been subjected to a “violent regime over time,” as family violence clause requires.

– Evidence picture in this case has been weakened to such an extent that I as a prosecutor is doubts about the circumstances can be proved in accordance with paragraph 219 (family violence clause, journ.’s note.). It does not mean that prosecutors do not believe in what the victim testified, saying Ek Sørensen.

assault

in the indictment against Ndure are listed six specific incidents of violence in the period January to November 2014. On Friday, it is clear that the prosecution drop all four of these.

the prosecutor believes it is proven that Ndure have committed two counts of aggravated assault against his former cohabitant, as well as that he has violated a restraining order. For this mean prosecutors that Ndure shall be sentenced to imprisonment for six months.

The first of the two episodes comes the night of 8 November 2014, when Ndure was arrested. According ekssamboeren shall Ndure then have strangled her, so that she “saw dots.”

– Fornærmde testified that she was close to losing consciousness, she saw dots and was dizzy. She was frantic and terrified, and that she can not explain every detail is perfectly natural, says Ek Sørensen.

The lawyer also points coroner Arne Stray-Pedersen’s conclusion that the injuries ekssamboeren had this evening suit with her own explanation. This assessment was Thursday disputed by defense expert, forensic scientist Lars Uhlin Hansen.

– changed the explanation

Ek Sørensen also believes Ndure changed their explanations about the night he was arrested. She notes that Ndure told police on the spot that he pushed ex over an armchair.

Then he said during interrogation that he had taken her sweater and pulled it down, and she fell over a suitcase. In court experiencing police explanation changed yet again, and that he must have twisted sweater so it came marks on the neck. How the police see it is the revised statement likely to cause arbitrary doubt, says Sorensen.

The other violence case påtalemyndiheten believe is proven, should have happened earlier the same month. Ndure should then have pushed ex down, while ekssamboerens spoke with two girlfriends on video service FaceTime.

Norway’s fastest man is also accused of having violated a restraining order against ekssamboeren, because he sent a message on Snapchat in Following the arrest. This acknowledges Ndure but denies criminal guilt.

The 23-year-old woman’s counsel, Siv Hallgren, asked Friday that Ndure should pay reparation damages the court’s discretion. It has previously been speculated that this may be around NOK 100,000.

Do Ndure must be acquitted

Ndure has always denied culpability. Defender has already described what happened the night of November 8th as “scuffles”.

Larsen has repeatedly criticized the police investigation to be unilateral, while she believes the victim woman has low credibility. Larsen also believes that the scuffles that occurred the night of November 8 due to provocation from ekssamboerens side, and that the court can not ignore the fact that 23-year-old bet Ndure ahead.

– This was a retaliation from his side. She kicks and bites, and he keeps her at a distance, until he finally pulls her into the suitcase. We are in an absolutely classic provocation situation that allows him to be acquitted, says Larsen.

Larsen does not deny that she believes the police have heard too much on the injured woman in the case, and believes this is substantiated by his violence charges against the woman were dropped because “no offense.”

– We should never have been here in court. This could have been solved in many ways, without destroying both a modeling career and a sports career, says Larsen.
