Two girls and a boy were killed in car accident on highway 25 in Hernes in Elverum last summer. The driver survived, and is now convicted of negligent bildrap.
According to the indictment had the car at a speed of at least 144 km / h in the 80 zone. 19-year-old believes he drove so fast.
– For low
South Østerdal Court believes that the imprisonment of one year and ten months is an appropriate sentence. 19-year-old is sentenced to pay 125,000 kroner for each of the six parents of the deceased, totaling NOK 750 000. He also loses leads right forever.
18 year old Oda died in the accident, her mother seems verdict is too low.
– If the judgment is appealed so I hope that it becomes stricter. There here have no deterrent effect on those who run as the defendant did. There are lots of them, says Gunn Knappe.
– Drove in of at least 135 km / h
During the trial it was published three rate reports discrepancy from 110 km / h to at least 160 km / h.
The court-appointed expert said that 137 km / h was an “absolute minimum value.” This mean the court is “an apt name,” and believes that the car had a rate of of at least 135 km / h when it hit the moose.
Prosecutor Sondre Kr. Halvorsen is satisfied with the verdict.
– It is located up the assertion of two years, and I think it will be generally deterrent. Prosecutors will decide whether prosecutors will appeal, but I do not think it is appropriate.
The boy’s lawyer, Helge Næss Rustad, has not read the judgment, and will not yet comment on it.
“Aimless speeding”
South Østerdal Court believes that the 19-year-old has acted with gross negligence, because he chose to drive so fast on a stretch of elgskilt, had tires tread depth 0.1 mm and made an illegal overtaking ahead of the accident.
The verdict says that the issue is not about “everyday driver’s” miscalculations or a “moment of inattention.”
This is “a situation where the driver chose to drive aimless speeding in a place with an increased risk of collision with animals in the road,” says the ruling.
He put both themselves and other road users lives at risk by driving so fast, says the court.
The District Court also uses words like “highly irresponsible, reckless and hazardous” on driving the 19-year-old.
He was convicted on all points of the indictment.
