80-year-old convicted of murder – got 13 years in prison – Sarpsborg Arbeiderblad

Sarpsborg District Court found yesterday the 80 year old Sarpsborg man guilty of intentional murder of his own wife through nearly 50 years in the couple’s house on Bjørnstad on March 17 last year.

Murder victim slept probably

In the new ruling says that right after a scrupulous assessment of the overall evidence that was presented during the three-day trial by Sarpsborg District Court last week raised beyond any reasonable doubt that 80-year-old shot his 72 years old wife in the head with a rifle in such a way that death emerged as a sure result.

– The incident occurred at the couple’s residence in the evening on March 17 in the deceased’s bedroom while she lay in bed, probably asleep, it says in judgment.

The woman died instantly of massive injuries she suffered.

– Deliberate execution

– Kills action bar the court’s view characterized by deliberate execution after defendant took out the rifle, one Krag-Jørgensen from World War II, which lay under the bed end of his bed, let five sharp cartridges in the magazine and went to his wife’s bedroom, which was located next door, while he took the cock outside the bedrooms. The court feels so evidence the situation now stands, convinced that the defendant went to the bed where his wife lay and aimed the gun muzzle against her mouth and then pulled the trigger as he stood at close range, writes Judge Thor Linde and the two lay judges in the judgment.

The court complied with the prosecution’s criminal allegation 13 years in prison for 80-year-old.

– That the accused has acknowledged the facts, but without acknowledging guilt, can not be accorded any appreciable effect, all the time this neither has relieved the investigation or court treatment, the court writes.

, must pay 200,000 kroner

In addition, the pensioner was ordered to pay 200,000 kroner in damages compensation to the couple’s son. 80-year-old is also deprived of the inheritance of his late wife and to sit in the undivided after her. He is also deprived of the right to insurance benefits after his late wife.

80-year-old claimed during the trial in Sarpsborg District Court last week that he had thoughts about killing his wife and that he took out the rifle to intimidate her after what he claimed was a vehement argument between spouses and that the shot was fired when he was struggling in his left leg and fell.

Sarpsborg District Court during its consideration of the question of guilt among other things, emphasized 80 -year-old explanations about the incident under the emergency call to the police homicide evening and what he told the police officers who arrived at the scene and during transport from the scene to the emergency room. At that time he told several times and several people that he had shot his wife that she was going to die.

– That shot was no accidental shot strengthened evidential of the defendant, having fired one shot , took new cock, but without cartridge came into the chamber, which technically was due to a mistake by spending spring, reads the judgment.

Will be appealed

His defense counsel, lawyer Harald Otterstad, had not been reading the verdict when SA was in touch with him yesterday afternoon, but is clear that the verdict will be appealed in its entirety. He added during the main hearing the claim that his client had to be acquitted.

The penalty as 80-year-old now imposed is higher than what is normal for his murder in Norway; 12 years in prison.

– In the present case occurred the murder of defenseless person in a private home, where one should feel safe. And the murder of close associates – so-called partner homicide – which in case law also is considered egregious, reads the judgment from Sarpsborg District Court.
