– This is an important decision, because it shows that apps are a new type of service that must be regulated by new legislation, says CEO of Uber Norway Carl Edvard Endresen. He is pleased with the ruling.

Thursday the Supreme court dismissed the appeal of the so-called Haxi case where three men were acquitted of pirate taxi driving, despite the court found it proved that they were up passengers without a permit.

The Supreme Court decision may have implications for other court cases concerning online taxi services, think Endresen.

Lawsuit against Uber driver

In October last year, a uber driver stopped and fined by police for pirate driving. The man refused to accept the fine and was acquitted by the Oslo City Court in January.

The basis for the acquittal was that it revolved around a single trip, and offer tour was not given the “public space” after the letter.

the ruling was appealed to the Court of Appeal, which countermanded the Oslo District Court acquittal because they believed the driver’s action covered by the general provision in the professional transport act, paragraph 4. it states that you must have permission to drive passenger fee.

This means that the decision of the Oslo District Court to be reconsidered, but prosecutors have waited to submit the indictment to the Oslo District Court pending the Supreme Court decision, which came Thursday.

– not punishable

After the Supreme Court rejected the appeal, said defense counsel for the Uber driver Jens-Henrik Lien the legal basis for the case in Oslo District Court is gone.

– There is no reason to see any difference or treat Uber and Haxi differently. I assume that this decision will have the same meaning for Uber such Haxi. This means that the original foundation that was cited against Uber driver is not punishable, says Lien.

He believes it is now up to prosecutors if they still want to maintain other possible basis, which does not is settled with this Supreme Court decision.

the prosecutors told NRK that have not been reading the Supreme Court’s decision in haxies case.

Want new legislation

Managing Director uber Norway Carl Edvard Endresen believes there must be a new legal framework for online taxi services as uber and Haxi.

– what is important for us now is to continue to support the authorities in efforts made to create a new and forward-looking regulatory framework for communications services for the benefit of Norway, says Endresen.
