This you are entitled by flystreik – Fædrelandsvennen

Consumer Council provides the following summary of your rights as an airline passenger for delays and cancellations:

EU Regulation 261/2004 provides rights by delayed or canceled flights. In case of delay, the duration of the delay and the length of the flight determine which requirements you have.

Your rights kicks in when the delay is:

more than two hours for flights of 1,500 km or less

mer than three hours within the EU and EEA area for flights over 1500 km

more than three hours outside EU and EEA area under 3500 km, or

more than four hours on all flights over 3,500 km.

Dersom one of these conditions is met, you, whatever the reason for the delay, claim:

Written notification from the airline about your rights

Meals and refreshments in a reasonable relation to the waiting time

Two free phone calls or similar

Free hotel accommodation if the new flight is first day after the scheduled departure time

Free transportation between the airport and accommodation

Ved a delay of over five hours, you can claim a refund for the unused ticket in addition to used ticket if the flight no longer serves the purpose of your original travel plan. In addition, you are entitled to return flight to the original starting place.

When a cancellation you are entitled to what is stated in the above points. In place of getting the money back for the ticket, you can also claim a handoff as soon as possible to the final destination, or at a later date by your own choice.

If you accept a refund for your tickets, airline catering will duty cease. This means for example that you no longer have the right to get paid food and beverage or hotel stays. In case of cancellation or delay of more than three hours, you may be entitled to a standard compensation. It is assumed that the delay or cancellation is not due to extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken.

However, it is less chance that the Regulation rules on standard replacement at longer delays and cancellations will come into force.

The Regulation has in fact a clause that air carriers commitments here should be limited or eliminated “in cases where an event is caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken. “

As an example of such extraordinary circumstances mentioned among other “strikes that affect the operation of an operating air carrier.”

Standard compensation has the following rates:

Flights exceeding 1500 km: € 250

Flights within the EU / EEA area over 1500 km, and all other flights between 1500 and 3500 km: € 400

All other flights: € 600

Manages airline by rerouting to get you to your destination within certain limits, reduced standard compensation by 50 percent.

When you have the rights?

Forordningen which provides rights apply to flights from a country within the EU / EEA, and flights from a third to EU / EEA where airline performing the flight is an EC aviation company.

You can additionally be entitled to extremes compensation pursuant to Aviation Act. For more information, contact the Consumer Council.
