Oslo District Court gives police upheld the forced relocation of Mullah Krekar – Aftenposten

The ruling by the Oslo District came Monday at 10, and Judge Oddmund Svarteberg supports the Oslo police.

Police Inspector Vegard Rødås the Oslo police argued in court that Mullah Krekar is still a fundamental danger to national security, and that the police were therefore fully entitled when they instructed Krekar to move for Names in Sør-Trøndelag and report to the police on Kyrksæterøra three times each week until of the year.

“Threaten national interests”

– We will now go through it before we give comments, says press officer of Oslo Police, Unni Waterhouse in a statement.

“No matter find the court that it is more than probable that Faraj still represents ein trugsel against fundamental national interests. The next question will then be whether there is sufficient reason to impose his residence city and notification in relation to the purpose of the measures, “the ruling said.

Police say themselves that they do not have the legal authority to refuse Krekar access to telephone and internet, and it is not least the past he has used when he has communicated with his followers.

– This is ANUNDSEN works

Editor Harald Stanghelle is not surprised Monday’s ruling.

– There are ng doubt that this was a minimum common denominator Attorney Anders Anundsen to make sure to get Krekar away from environments he could influence in Oslo, says Stanghelle.

He believe the justice minister today is relieved the ruling, which was immediately appealed Monday.

Potential gift package

– The challenge is that other countries must request Krekar extradited, must cooperate with investigation. There has been talk of threads to both Germany, Australia and Italy earlier. It had been a gift package for Norwegian authorities, says Stanghelle.

In Norway Krekar atoned finished and is in principle a free man.

The court has not listened to a secret memo PST boss Marie Benedicte Bjørnland sent to Ministry of Justice on September 24, 2014.

“In individual cases it will from PST standpoint, however, also be appropriate that that person is present in the city and near a relevant environment,” and further:

“In individual cases will an order determined whereabouts have little effect as long as the impact is mainly carried out on social media.”

-Will be appealed

Islam Researcher Lars Gule think this matter should go all the way up to the Supreme Court.

– Whatever decision will probably be appealed this further because this is still uncharted legal ground. Here needed a Supreme Court ruling to explain what the law is and how it should be understood, says Gule.

Krekar lawyer, Brynjar Meling, think last words first will be said in the Court (ECHR) in Strasbourg on police should prevail in the Norwegian legal system:

-Mulla Krekar is a man of principle, and it is important to get tested what is a violation of individual rights, says Meling, as Monday is in Sandnes.

On a secret address

Mullah Krekar released from Kongsvinger prison last Sunday after serving the sentence of two years and ten months fengel threats against Erna Solberg and three Kurds.

He has spent time after release with the family only interrupted by Tuesday’s court hearing in Oslo District Court.

Krekar now live at a secret address in Oslo, according to Meling they agreed that Krekar should not comment on the matter on their own.

Expelled in 2003

It has now been over seven years since the Supreme Court ruled that Mullah Krekar may be expelled from Norway.

He moved to Tønsberg from Northern Iraq as a quota refugee in 1991, and was decided expelled first time in 2003. Since 1993, the family lived at several different addresses in Oslo.

The Government Stoltenberg and Solberg both tried to get sent Mullah Krekar out of country, Germany, Switzerland, Australia and most recently Italy has been promoting as possible options:

– There is no such thing as the transfer of persons to Italy. They can add so much plans they want about this, but Mullah Krekar is a person who has their human rights. That means he has a convention protected demands to be treated by a legal framework, says Meling.
