- The evidence gives far more meaning in a suicide theory – Dagbladet.no

DRAMMEN District Court (Dagbladet): – The conclusion must be: Timeline makes sense from a suicide theory but considerably resistance from a murder theory. It is enough to give a reasonable doubt, and therefore the defendant is acquitted of murder.

It says lawyer Anders Westeng in his closing argument in the so called director murder case. A 53-year-old woman is accused of premeditated murder of her husband, Frontline CEO Per Gunnar Asheim (57), two years ago. Although she has constantly refused culpability and defenders find it far more likely that Asheim killed themselves, to bring his wife convicted.

• Defence claim: The defendant is acquitted of premeditated murder and two counts of influence of witnesses. She sentenced for abuse of children and other cases of witness influences, but considered the mildest way.

The prosecuting power laid yesterday the claim supreme penalty for Tranby-woman – 21 years in prison.

Breakups

Director motive to put themselves in the wife’s car and set fire to himself was, according to the defense to get her convicted of murder. The design was the bitter cohabitation and child custody case pair was up. In addition, he struggled at work, where he had recently received a warning. Envisioning new job abroad seemed unrealistic.

– Asheim considered the situation as quite dark. The children were on their way out of the home, and no millions were heading abroad. It makes sense, says Westeng.

Prosecutors – police lawyer Vibeke Martins and Attorney Trude Elisabeth Sparre – listed under its procedure in going up nine key points that will prove that the 53-year-old woman drugged her husband and placed him in his own BMW convertible, which she then set fire to.

Defender Westeng and colleague Hildemarie Ims mean prosecution argument is full of logical flaws and gaps, and reminds us that it is Martins and Sparre task to prove the defendant’s guilt; it is not the defendant’s task to prove his innocence.

He stressed that even murder theory is his and Ims’ idea alone, and not the defendant.

– Not credible

Westeng and Ims believes prosecutors are unable to explain how Asheim could disappear in the evening on Monday 25 March, then suddenly emerge death in his wife’s car two days later.

Neighbors testified that they, inter alia, so Asheim working in the garden Tuesday, but the defenders cast doubt on their credibility; a neighbor changed explanation considerably during interrogations.

– First she said she chopped snow out when she saw Asheim. So she changed it to that she sat on the second floor and did needlework, the lawyer said.

Mobile Movements

A key factor is that Asheim Iphone according location data lying idle at Tranby ever since he should have been gone Monday to suddenly moved minutes before it stopped working 3:15 Tuesday night – when it is believed that it was destroyed in bilbrannen. In addition, some turned the alarm on his wife’s cell phone, which always used to call 7:30 and someone logged onto her PC 2:45 to 1:00 hour before bilbrannen.

According defends Westeng found Asheim near the home that particular night.

– He watches while the family goes to rest. Then he entered the house. The first thing he sees is his wife’s mobile, he disables the alarm. Then he goes into her PC, but does not create documents – maybe he just looks. Then he took his phone, which has remained silent, and running up the force (the place where the car was found). The car burns at 3:15.

Westeng think Asheim wanted his wife would sleep until police knocked on the door, maybe 07-08 o’clock, and make a scene, because of his notorious temper. That, along with evidence he had planted, should have her charged with murder.

Bilbrannen was discovered much later, and then it was already the wife woke up. She was called by police and informed about the fire (but not death) in 10 o’clock.

– Illogical

The defense also find it illogical that Asheim was found on the passenger side of the burnt car; if the wife wanted to get it to look like a suicide, it would natural be to put him in the driver’s seat.

– It offers me very opposed to arrange something in such a way, the lawyer said.

He also points out that it was found cigarette residues and cans of beer on the ground by the car.

– This shows that Asheim was alive on fire time, says Westeng.

– Only explanation

Westeng devoting much of the procedure to place all of the undisputed facts of the case on what he calls timeline. The aim is to highlight what he and Ims believes are gaps and deficiencies prosecution only has swept aside.

– Asheim disappearance can not be explained otherwise than suicide theory, the lawyer said.

He points out that 57-year-old on Monday set and used Apple program Find My Iphone. How he gained knowledge about the location and base stations, he said.

– Could be his fingerprints

In the late director’s blood was found traces of sedative and analgesic agents. Prosecutors attribute this to drug residues different places in the house, including in a newly purchased coffee grinder and a water bottle. But this also rejected by Westeng and Ims, they mean Asheim himself may have planted evidence when he should have bedroom on in the house ahead of bilbrannen.

– Not identified fingerprints on the mill and the bottle may well be deposited by him, says Westeng.

Martins and Sparre claims the defendants wife wondered medications in Asheim. Defense seems on its side that it is quite unlikely, since the substances have strong taste. In addition should the concentration in his blood been stronger since the breakdown time for several of them are long.

Westeng and Ims also points out that it went very long time – 13 hours – from the arrest of the wife of police cordoned off house. In large parts of this period was the couple’s second oldest daughter and the maid (designated by police who accused accomplices) present without evidence was removed.

– The only reason she did not removed mill is that she knew nothing about it had a meaning, the lawyer said.
