- The bishop, noting henleggelsen with satisfaction – the Newspaper.en

(Newspaper) on Monday accused the Oslo public prosecutors økonomisjefen in the Oslo catholic diocese of rough financial fraud after medlemsrotet in the church.

the Diocese is also subject to a fine of one million rupees.

the Case against bishop Bernt Eidsvig, who was indicted for aggravated fraud, is dismissed.

- There is no evidence to suggest that Eidsvig has had direct dealings with “telefonkatalogmetoden”. The public prosecutor has furthermore under no doubt come to that Eidsvig not had such a clear understanding of the medlemsregistreringspraksisen that there is a basis to impose on him a personal criminal responsibility for not having intervened and stopped/changed this, says førstestatsadvokat Kristian Jarland at the Oslo public prosecutors.

I have also on his behalf denied that he has done something punishable. It came as no surprise to him that the case against him is dismissed. But it is nice to get the district attorney endorsed on it, ” says Lyngtveit, who stated that the bishop also sets the rejected to the indictment against økonomisjefen.

- Unjustified state aid

Eidsvig has even admitted that there had occurred a failure in the kirkas routines, because people wrongly been registered as members.

Forelegget on a million is imposed because employees of the diocese in the period from 2011 to 2014 used the telephone directory to come up to the people with the “catholic-sounding names”.

Then collected the national identity number to these people and identified them as the members in annual applications for state aid. The public prosecutor believes the church thus received state aid for people who in reality were not a member.

Under the doubt, the prosecutor limited the deceit of at least 2 million. The reason for that the amount not be higher, is that it is considered difficult to determine with sufficient certainty how much state aid the diocese incorrect has been received, writes NTB.

Not illegal

the church Has received illegal state aid?

Our opinion is that the church does not have got more than what they were entitled to. The church had had a better registration system, one would got a lot more. You have not managed to register all those who were actually members of The catholic church, and who were resident within the church area. One has failed to capture the actual number of catholics was stønadsberettiget, says Lyngtveit.

- Not proof

Anders Brosveet defender økonomisjefen. The client sets rejected to bedrageritiltalen.

” We are surprised that the public prosecutor take out a prosecution for fraud, which requires that we must have a purpose about uberettighet gain. He should be judged by their own perception of the tilskuddsreglene when the applications were sent. That the County and the district attorney believes that his legal opinion is wrong, has nothing to say for straffbarhetsspørsmålet. My client has never gone in to get the money that was not eligible, ” says Borsveet to the Newspaper.

- It is quite obvious that the district attorney will not find evidence that my client had such a purpose, ” adds the defender.

Civil case

In February last year, after the Newspaper through a number of articles had revealed medlemsrot in The catholic church in Norway, reported the County governor in Oslo and Akershus diocese for medlemsjuks. At the end of next week comes the civil trial between the diocese and the State by the Ministry of culture in Oslo district court.

Diocese went to the civil action because it believes there is no basis for the ministry to impose them to repay the approximately 40 million they received in state aid in the period 2011 to 2014.

the State on their side, believes that the diocese has registered members on the assumption that they were catholic, with starting point in country of residence, and name, and that it requires an active registration in order to get support for a member. The church receives public funding according to the number of members.

There are a set of six rettsdager to the civil case, from Friday 2. December to Friday 9. December.
