Penguin Mystery: The roof of the cage was opened, but no one admits to having taken something – Dagbladet.no

(Dagbladet): Penguin chicks who on Thursday was taken from the Atlantic sea, have now been without food and warmth from their parents for two and a half days. This means that all hope of finding the three small animals alive, are out.

At the same time working with the police to solve the case. Four people – all Russians – were yesterday charged under the Animal Welfare Act § 14 b: to “Abandon animals in a helpless condition.”

Opened penguin cage

All four admit to having taken into the area where the penguin chicks were kept in cages. Police freed yesterday overvåkningsvideon from the park, showing more people in the Russian dress who cross. Police have not confirmed the basis of the material they bring with them something out of the park, and people who have been questioned, deny that they have brought something.

– It is also recognized that some have lifted up the roof on these penguin cages, but they say they have not taken anything. A roof on the cage has been lifted. It is also confirmed from the Atlantic sea. The roof was slightly skewed, so someone must have been involved in it, said police inspector Yngve Skovly Dagbladet Saturday afternoon.

– What have the Russians explained that they did on the site?

Skovly says, however, that as of now no proof that penguin chicks disappeared when the accused persons were inside the area.

Police also seized mobile phones and looked through phone pictures. He explains that these images are not fully analyzed.

– We will continue the investigation and check out tips. We have enough information to work with, to put it that way. I must also emphasize that the accused are not guilty until they are convicted, he said.

– Asking to be believed

Lawyer Reidar Andresen, representing three of the defendants in the case:

– To ascertain that they have taken penguin chicks and / or egg is not possible to determine from surveillance video. It claims they also stubbornly that they have done, and what they are asking to be believed, he says to Dagbladet late Friday night.

– As the case now presented, it seems that both the media and public opinion has ruled in the case before the police have investigated this done, the lawyer said.

He says the matter is an enormous burden for the individual and for families.

– The case produced so far in my opinion, unbalanced, and has so far not in any Field safeguarded the legal rights of those currently designated to have been in the field, says Andresen.

The lawyer says he has recorded to the police if it can be other than school leavers who have brought penguins – whether two-legged, four-legged or birds.

Lawyer Axel Lange has been appointed as defense counsel to the fourth accused in the case, he acknowledges not having taken penguins.

– He does not know why the penguins were taken, or who has taken them. He feels put in a real squeeze, says Lange told Dagbladet.



Risking imprisonment

If prosecutors were to fall down on that violation is serious, open Welfare Act § 37, second paragraph of imprisonment in untill three years . Police Attorney Skovly says they have not taken a position on this.

Dagbladet know of only one case where there has been a conviction to Abandon animals in a helpless condition, when a farmer was sentenced to 75 days imprisonment in Dublin District Court in 2012.
