Police lost litigation about fingerprints – Dagbladet.no

Police believe there may be evidence of drug dealing on the man’s phone. They have phone, but does not travel past the fingerprint lock, writes Aftenposten.

– We have some evidence that provides reasonable grounds to suspect, and we want to access the phone to investigate further. The accused did not want to assist by providing code to the phone, and therefore we have gone to court hoping that fingerprints will make it possible to open the phone, said the prosecutor in the case, police lawyer Ole Morten Paulsen, said.

the court was in doubt whether there is a clear legal basis in the Criminal Procedure Act to force someone to give fingerprints on a cell phone. Thus was the ‘not insignificant doubt “ruling in the case. Police warned that they will appeal the ruling, and that they want a principled decision on the issue.

– How handsets functioning today, this issue is becoming increasingly common, says Paulsen.

The court in its decision considered two recent decisions of the court of Appeal, both of which landed on the opposite Lister District court. One of these will be appealed to the Supreme Court, and the decision which may be govern how the law should be practiced. (NTB)
